Court and dispute over TDC NET’s critical telecommunications infrastructure

The case involved a claim that the authority’s decision to prohibit maintaining a specific agreement between TDC NET and Huawei, as well as the use of equipment supplied under the agreement, was unlawful. The decision was made under the law on supplier security in critical telecommunications infrastructure (telesecurity law), which allows the Agency for Civil Security to prohibit the continuation of agreements between major telecom providers and suppliers if the agreement poses a significant threat to national security. The Court of Appeal also found that the decision had such a nature and intensity that it constituted an expropriative intervention.
